Heavy Duty Motor Vehicle Idling Limitations

Local
governments in the 5-county Austin-Round Rock metropolitan statistical
area (MSA) have agreed to implement the state rule for idling of heavy
duty vehicles (HDV). The rule limits HDV idling to 5 minutes
from
April 1 to October 31 (ozone season) of each calendar year, with several exceptions in which the rule does not apply.
As of September 1, 2009 the exemption authorizing heavy duty vehicles to idle when idling is necessary to power a heater or air conditioner while a driver is using the vehicle’s sleeper berth for a government-mandated rest period has expired.
Although bills were
introduced in the recent legislative session which would have extended the
idling restriction exemption, none were ultimately passed. Therefore, the
sleeper berth exemption as detailed in subsection # 12 of the state motor
vehicle idling limitation rule (TAC 114.517) expired on September 1, 2009, in
accordance with language contained in the rule specifying expiration. For more

signing a Memorandm of Agreement (MOA) with the Texas Commission on
Environmental Quality (TCEQ), the following local governments have
